Divorce Document Preparation Checklist
Use this list to prepare for reading your court’s instructions or speaking with a lawyer. It is an organization aid, not a list of documents every court requires. Keep the records privately; do not submit them to this website.
1. Identify the source and case
- State and county where you expect to file.
- Current court or legal-aid instructions and their source address.
- Existing case number, if any, and copies of papers received.
- Your role: starting, responding, filing jointly or preparing final documents.
- Questions about eligibility, jurisdiction or an existing order.
2. Gather records to review
- Marriage information and relevant dates.
- Income records and tax returns requested by the applicable instructions.
- A list of property and debts, with supporting records.
- Existing support, parenting or protection orders.
- Insurance and child-expense records where relevant.
Gathering a document does not mean it must be publicly filed. Check confidentiality and redaction instructions before giving records to anyone.
3. Check the filing process
- Correct current forms and any local cover sheets.
- Filing methods, fees and fee-waiver application.
- Service instructions and response deadlines.
- Signature, notarization and copy requirements.
- Financial disclosure, hearing and final-order steps.
4. Keep a clear record
- Save a copy of the forms you actually filed.
- Keep filing receipts, service records and court notices.
- Record deadlines from the actual instructions or orders.
- Check what remains necessary before the case is final.
Find the relevant provider in the state directory. For budgeting questions, see divorce costs and lawyer quotes. This checklist does not determine what a judge will require in your case.
