Overview

Divorce in Hawaii: no clocks at all

Hawaii is one of the most permissive states in the country: there is no minimum residency period and no waiting period. You only need to be domiciled in Hawaii on the day you file — physically present with the intent to stay. The Family Court handles the case, and the only ground is that the marriage is irretrievably broken, making Hawaii a strict no-fault state.

What Hawaii does have is a practical quirk: a divorce involving minor children costs more because of the mandatory Kids First parenting education program. Filing runs $215 for couples without children and $265 with children, with the extra amount funding the program both parents must complete before the case can proceed.

Property is divided equitably, and child support follows the Hawaii Child Support Guidelines under HRS § 576D-7. Because there is no waiting period and no residency threshold, an uncontested case can finish in as little as six to ten weeks. The forms come from the Hawaii Judiciary, and most filings happen online through the JEFS e-filing system.
