Overview

Getting divorced in Arizona

Arizona runs on community property, so anything you and your spouse acquired during the marriage belongs to both of you and gets divided when you divorce. That includes income, houses, cars, and retirement accounts. Separate property — what you brought in or inherited alone — stays yours. You file the Petition for Dissolution of Marriage with the Superior Court in the county where either of you lives.

Residency is the easiest of any western state: just 90 days in Arizona before you file. After the papers are served, a mandatory 60-day waiting period runs before the court will enter the decree. Even in an uncontested case, both spouses typically attend a short final hearing where the judge confirms the agreement.

Arizona uses its own vocabulary: custody is called “legal decision-making and parenting time,” alimony is “spousal maintenance,” and child support follows the Arizona Child Support Guidelines under A.R.S. § 25-320.
