Overview

Divorce in Oklahoma: the children wait

Oklahoma splits its timeline right down the middle: a couple without minor children waits just 10 days after filing, while a couple with children waits 90 days under 43 O.S. § 107.1 — a gap designed to give parents time to think through custody and support. The 90-day clock can be waived only for narrow statutory reasons, like extreme cruelty or a year of abandonment.

The no-fault ground is incompatibility under 43 O.S. § 101, used in roughly 90% of cases, and Oklahoma recognizes twelve total grounds. Eligibility takes six months of residency, with the filing spouse also living in the county for 30 days. The Petition for Dissolution of Marriage goes to the District Court, filed with a summons and civil cover sheet — Oklahoma has no state-run online filing system for self-represented filers.

Property is divided equitably, and spousal support is called spousal support. Child support follows the Oklahoma Child Support Guidelines, and custody is decided under the best interests standard. Filing fees range from $183 to $258 depending on the county, with Oklahoma County around $224.
